Metaphysics aside, I think top is correct. Next time you capsize, before you flip the boat over, swim under it an poke your head in the cockpit. There won't be much water in there. The water enters when you try to flip it over, and end up scooping some in the cockpit. So there will only be substantial water in the cockpit when it's right-side-up.
