Hi Ian,
Your post covers a lot of good points in an interesting way. A good read.
I think the problem that started this whole thread,[tho now its a giant fat cable] is that a lot of people are mixing micro-managed "liabilities" with Gross Negligence. Practicality and realism rules out [usually] the necessity for papers, merit slips, certificates and the like for the most mundane and basic personal responsibilites. Where I depart from some of the other posts here is where there was clear deception or negligence in notifying the kayaker of the difficulties involved. Now others would micro-manage that line to mean it involves wether or not you tied your shoelaces right. In reality my emphasis is on far more apparent dangers. Consider a guide leading his people down a river hes advertised as CLASS 2. Now say someone gets killed and low and behold, some experts attest to the fact that the river was infact a CLASS 5 at the particular place this individual got killed. That "guide" is in deep water, Hell, I'd even say CLASS 7!!!!!
