Now were off on a fun tangent! Interesting perspective: The legal process/profession will decide who is responsible/liable. Makes sense once the parties in conflict can't come to their own resolution. Maybe John has something to add here.
I'm still puzzling my head over the tobacco settlement. Jeez if the stuff was illegal there would be no one to hold liable. Deep thinking.
Had an interesting scenario happen, a friend that is a physician/paddler questioned the idea of a medical form as well as a liability waiver. "you are presuming to diagnose" since the form asks about any injuries or conditions the person might have. He was concerned because a 65 yr.old friend had taken a class and was wiped out, "Don't you screen people for classes?" My response "in the sense that the person is told what the course is about I think they have the primary responsibility to judge if they are capable, I do not know their capabilities as well as they do, the idea is to learn successfully not cull the herd. What do you suggest?" "Why they should get an OK from their doctor saying they are capable of the activity" "Is that something that I should require for people of a particular age?" "Possibly"
The conversation didn't go farther as the second round of kebabs were ready, but there's someone else's valid perspective.
How about the somewhat obese person that has a dificult time sitting in a kayak, should i ask for a certification to sit?, on a roll here, should there be certification for assisting disabled folks? " MR. Lee, but did you have any specialized training for teaching the sling assisted rescue for people disabled by years of repetitive keyboard injury?" "well did you?" AAAAAAAAHHHHHHHH "I confess,i can't take it anymore, they said they wanted adventure, they said they wanted to look like Robert Redford and Meryl Streep in Maine, i tried, i cracked lame jokes, i told them their torso twist was marvelous, i just didn't know they were going to go out on their owwwwwwnnnnnnnnnnnn."
