You've raised some very valid points. I still wouldn't say that all lawsuits stem from facts--it's the high-profile, high-dollar frivolous lawsuits that give litigation such a bad image in the public eye (mine especially included!).
I suppose, as Lee said, that guides who advertise trips for "beginners, no experience required" are liable for getting clients in over their heads.
I guess I'm not one who really enjoys debating the sides of a lawsuit--I hear the word and a defensive shell pops up and I try to avoid the fact that they occur around me in my daily life (and are possible in situations in my favorite sport, which really scares me). I guess that's the way it is.
But I don't have to like it!!! ;) Shawn
