Yes, a guide carries a huge responsibility that no amount of insurance will cover and no fee can pay for. When someone trusts you it is a very real and tangible thing. To betray that trust is painful for all concerned. Enough generalities. I think the liability waiver I spoke of is an incredibly crude indicator of how (generally speaking) people may be removed from knowing what they are personally responsible for.
I will gladly take your statement that lawsuits stem from facts, and merits of a lawsuit depend on those facts. This is a forum for various reasons, and a business that is one individual has been declared incompetent. Imagine being that person as well as the experience Byron stated originally. That is what I was crudely attempting to communicate.
There are many examples of lawsuits for what nearly every person with a scintilla of empathy would call "good" Ones that exemplify eternal verities of truth and sense of rightness. After that things can get a little gray. Depending again on the facts, etc. Bye the bye there's a lyric in a musical, groups of abolitionist singing "We refuse,,,to be confused,,,byyee the facts..." just came to mind.
Anywho, I like the stories.
