Again, Ive no intention to test it, its interesting to ponder tho. I recall a famous movie star woman. She had Beach front property too and wanted to have it her own so much that she built a privacy fence right into the ocean!! Alas, the law stepped in and tore down the offnding portion. Once again fans and such treaded on her beach snapping pictures and the like. I recall another instance in local Greenwich Connecticut. In this case a resident lawyer was offended with the fact that Greenwich had a "private beach", naturally meaning that the non-residents were not allowed - at all. Well, the resident lawyer fought for ther ban to be lifted because the greenwich seashore is infact national seashore which cant restrict any particular U.S. citizen based on the town they lived in. It seemed like an open and shut case, but would you believe the lawyer lost! I dont know what the loophole was , but Im guessing that the actual ACCESS to the Greenwich beach was probably proven private regardless of the actual open seashore status.
