In regards to imminent collision, don't let people off the hook that easy. If they are in the position of an imminent collision it means that they have already screwed up and anything they do is dangerous.
The idea which you have been putting forth is correct in my opinion. Don't worry about imminent collision, worry about avoidance in the first place. Knowing and following the rules prior to a dangerous situation is the ABSOLUTE BEST way to protect yourself.
Because the rules do not apply in an imminent collision situation there is little sense discussing it. The idea would be to avoid the situation and address the problems that would put you in this situation.
