This is probably worthy of it's own thread - as most posts I have seen tell me a lot of paddlers are clueless on this. I am surprised that so far the respondents all agree and understand the rules. Usually this topic gets a different set of responses.
I frequently see posts on boards where people advocate blowing whistle and air horns and waving paddles (requires one to stop paddling!) - while expecting other vessels to give way and avoid them - rather than just moving! Their belief that they have any sort of right of way puts them at risk and endangers other vessels.
Part of these differences have to do with location though.
I paddle coastal waters, ICW, tidal river, etc. Lot's of busy waterways and a fairly busy port. Traffic has channels to follow for the most part. Rules are useful and make sense here. Giving way to all other vessels is easiest and most logical way to operate a kayak here. Generally very easy to stay mostly out of the way, and to time channel and port crossings with plenty of time. The bigger the boat, the less I'm likely to have any issues with it. Ski boats and PWCs bear more watching than a cruise ship, tanker, or mega-yacht. Act like a boat - no problems. Act like a water toy - good luck (applies to lighting here as well - r/g/w setup is much appreciated - waving a flashlight, while in regs, would irritate others or indicate you needed their help).
Many paddlers are on inland lakes and large rivers with lots of smaller pleasure boats, bass boats and PWCs that follow no traffic lanes and operate at high speeds. Very different situation. More of a free for all. Everything afloat is a toy. Makes me glad I paddle where I do.
