I am trying to understand the ethical and legal way to make and sell kayaks.

There are lots of businesses building boats created by other designers. The standard system is to pay a royalty. This royalty is agreed upon in advance.

The obvious solution if this is unacceptable is to build boats of your own design. This assures you are not impinging on any ethical issues. If you don't have the skills or experience to design your own boat, then the value of paying someone who does should be clear.
